Terms of service

Last updated: October 15, 2026

These Terms of Service govern access to and use of the KOWA online store at kowaxis.com and purchases made through the store.

Throughout these Terms, “KOWA,” “we,” “us,” and “our” refer to KOWA, an independent clothing business operated in the Republic of Korea.

Use of the website is subject to these Terms. When you place an order, you agree to the provisions of these Terms that apply to your purchase, subject to applicable law.

These Terms should be read together with KOWA’s Privacy Policy, Shipping Policy, Return and Refund Policy, and any other policies or notices made available on the website.

Nothing in these Terms limits or excludes any mandatory consumer right or remedy that cannot lawfully be limited or excluded.

1. ONLINE STORE

KOWA operates an online store offering clothing, accessories, and related products.

The availability of products, markets, currencies, shipping methods, payment methods, and other services may vary depending on the customer’s location.

KOWA may update, modify, suspend, or discontinue parts of the website or its services where reasonably necessary, subject to applicable law.

2. ELIGIBILITY

By placing an order, you confirm that you have the legal capacity to enter into the purchase under applicable law.

If you are a minor under applicable law and a transaction requires the consent of a parent or legal guardian, you or your legal guardian may have the right to cancel the contract where that required consent was not given, as provided by applicable law.

You must provide accurate and complete information when placing an order or creating a customer account.

You are responsible for keeping access to your customer account and email account secure.

3. PRODUCT INFORMATION

KOWA makes reasonable efforts to describe and display products accurately, including their materials, construction, dimensions, fit, color, features, and care requirements.

Because screens, lighting conditions, photography, garment washing, natural material variation, and manufacturing tolerances may affect appearance, minor differences may occur between a product as displayed online and the physical item received.

Measurements provided by KOWA are approximate unless expressly stated otherwise. Small production or measurement variations may occur.

Nothing in this section affects a customer’s rights where a product is defective, materially different from its description, or otherwise does not conform to the contract.

4. PRODUCT AVAILABILITY

Products are subject to availability.

Adding an item to a cart does not reserve that item.

KOWA may limit quantities available for purchase where reasonably necessary, including for limited-production items.

If a product becomes unavailable after an order has been placed, KOWA will notify the customer and refund any amount paid for the unavailable item in accordance with applicable law.

5. PRICES AND CURRENCY

Unless otherwise indicated, prices on the KOWA online store are displayed in United States dollars (USD).

Market-specific prices may differ depending on the customer’s selected country or region.

Where required, applicable domestic taxes may be included in the displayed price or calculated as indicated during checkout.

A customer’s bank, card issuer, or other payment provider may apply its own currency-conversion rate or additional fees. Such third-party charges are outside KOWA’s control.

KOWA may change product prices prospectively. A price change does not affect an order that has already been validly concluded, except where correction is permitted by applicable law.

6. INTERNATIONAL DUTIES, TAXES AND IMPORT CHARGES

International orders may be subject to customs duties, import taxes, brokerage charges, handling fees, or similar charges imposed by the destination country, customs authority, postal service, or carrier.

Unless KOWA expressly states at checkout that such charges have been prepaid or included, these amounts are not included in the product price or international shipping charge and are generally the responsibility of the recipient.

KOWA does not control the assessment or collection of destination-country customs charges.

Nothing in this section limits any disclosure or pricing obligation imposed by applicable consumer law.

7. ORDERS

When you submit an order, you request to purchase the selected products.

KOWA may accept or reject an order in accordance with applicable law.

KOWA may be unable to accept or fulfill an order for reasons including:

• A product is unavailable
• Payment cannot be authorized or completed
• Information supplied with the order is materially incorrect
• There is a clear pricing or technical error
• Fraudulent or unauthorized activity is reasonably suspected
• The order violates applicable law or these Terms

Any refusal, correction, or cancellation of an order will be made only to the extent permitted by applicable law.

If KOWA cannot accept or fulfill all or part of an order after payment has been collected, KOWA will refund the amount paid for the affected portion in accordance with applicable law.

Nothing in this section limits a customer’s statutory rights concerning contract formation, cancellation, refunds, or performance of the contract.

8. PAYMENT

Payment must be made using a payment method offered during checkout.

Available payment methods are those displayed to the customer during checkout.

Payments may be processed by third-party payment providers and are subject to their applicable technical and security procedures.

KOWA does not receive or store complete payment-card details where payment information is handled directly by an authorized payment processor.

9. SHIPPING AND DELIVERY

Orders are shipped in accordance with KOWA’s Shipping Policy.

Shipping options, charges, estimated delivery periods, and carrier availability may vary by destination and are displayed where applicable during checkout.

International shipments may be handled through Korea Post EMS or another appropriate shipping service.

Delivery estimates are estimates and are not guaranteed unless expressly stated otherwise.

KOWA is not responsible for delays caused by customs processing, carrier disruption, severe weather, government action, incorrect customer information, or other circumstances outside KOWA’s reasonable control, except to the extent applicable law provides otherwise.

Nothing in this section limits KOWA’s responsibility for delivery or the customer’s remedies where applicable mandatory consumer law provides otherwise.

10. RETURNS, CANCELLATIONS AND WITHDRAWAL RIGHTS

Returns, cancellations, refunds, and statutory withdrawal rights are governed by KOWA’s Return and Refund Policy and the mandatory consumer laws applicable to the transaction.

KOWA maintains market-specific return and cancellation rules where appropriate.

Eligible customers may submit return or cancellation requests through the KOWA customer account at:

KOWA Customer Account

KOWA also makes withdrawal and cancellation forms available where required at:

Withdrawal and Cancellation Forms

Customers may contact KOWA at:

contact@kowaxis.com

Nothing in these Terms restricts any statutory right to withdraw from, cancel, return, repair, replace, or obtain a refund or other remedy in connection with a purchase.

11. CUSTOMER ACCOUNTS

Customers may be able to create or access a KOWA customer account using email authentication or another authentication service made available through the online store.

Customer accounts may allow customers to view orders, manage certain account information, and submit eligible return or cancellation requests.

You are responsible for ensuring that the email address associated with your account is accurate and accessible to you.

KOWA may restrict or suspend an account where reasonably necessary to prevent fraud, abuse, unlawful activity, or unauthorized access.

12. INTELLECTUAL PROPERTY

Unless otherwise stated, the KOWA website and its original content, including KOWA names, logos, graphics, product designs, photographs, videos, illustrations, text, layout, and other creative material, are owned by KOWA or used with authorization.

These materials may not be reproduced, distributed, commercially exploited, modified, republished, or used to create derivative commercial works without prior permission, except where permitted by applicable law.

Nothing in these Terms transfers ownership of KOWA intellectual property to the customer.

13. PERMITTED USE OF THE WEBSITE

You may use the KOWA website for lawful personal shopping, product research, account management, and other legitimate purposes.

You must not knowingly:

• Use the website for fraudulent or unlawful activity
• Attempt to gain unauthorized access to the website, customer accounts, servers, or systems
• Introduce malicious code, viruses, or other harmful technology
• Interfere with the normal operation or security of the website
• Scrape, reproduce, or commercially exploit substantial portions of the website in violation of applicable law
• Impersonate another person or provide materially false information
• Use the website in a way that infringes the rights of KOWA or another person

KOWA may take reasonable steps to protect its website, customers, and systems from such activity.

14. THIRD-PARTY SERVICES

The KOWA website may rely on or link to third-party services, including ecommerce platforms, payment processors, shipping carriers, authentication services, and external websites.

Those third parties may operate under their own terms and privacy practices.

KOWA is not responsible for third-party services to the extent that responsibility lawfully rests with the third-party provider.

Nothing in this section excludes or limits any responsibility that KOWA is required to bear under applicable law.

15. WEBSITE AVAILABILITY AND ERRORS

KOWA aims to maintain accurate and accessible website information but does not guarantee that the website will operate without temporary interruption, technical error, or maintenance.

KOWA may correct typographical errors, inaccurate information, technical errors, or omissions when discovered.

Where an error affects an existing customer order, KOWA will address the matter consistently with applicable consumer law.

16. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Nothing in these Terms excludes or restricts mandatory consumer rights or any liability that cannot legally be excluded or limited, including liability arising from fraud, intentional misconduct, gross negligence, or other liability that applicable law requires KOWA to bear.

To the maximum extent permitted by applicable law, KOWA will not be responsible for losses that were not reasonably foreseeable as a result of KOWA’s breach of these Terms or other legal obligations.

For consumers, this section applies only to the extent permitted by the mandatory law governing the transaction.

17. EVENTS OUTSIDE KOWA’S REASONABLE CONTROL

KOWA will not be responsible for delay or failure to perform caused by circumstances beyond its reasonable control, including severe weather, natural disaster, war, civil disturbance, government action, customs disruption, carrier interruption, labor disruption, failure of telecommunications infrastructure, or similar events, except to the extent applicable law provides otherwise.

Where such an event materially affects an order, KOWA will take reasonable steps to communicate with the customer and comply with any cancellation, refund, delivery, or other obligations required by applicable law.

18. PRIVACY

Personal information is processed in accordance with KOWA’s Privacy Policy and applicable data-protection law.

Use of third-party services such as payment processors, shipping companies, authentication services, and ecommerce infrastructure providers may require personal information to be processed by those service providers as described in the Privacy Policy.

19. CHANGES TO THESE TERMS

KOWA may update these Terms when reasonably necessary, including to reflect changes to the website, business operations, payment or shipping services, or applicable law.

The version in effect at the time an order is placed will generally govern that order unless applicable law requires otherwise.

Material changes will not retroactively remove rights already acquired by a customer.

The current version and its effective date will be made available on the KOWA website.

20. GOVERNING LAW AND CONSUMER RIGHTS

These Terms and transactions with KOWA are generally governed by the laws of the Republic of Korea, without prejudice to any mandatory consumer-protection law that applies to a customer in another jurisdiction.

If you are a consumer residing outside the Republic of Korea, nothing in these Terms deprives you of mandatory protections granted by the law applicable to you.

Nothing in these Terms prevents a consumer from bringing a claim before a court or dispute-resolution body where applicable law gives that consumer the right to do so.

21. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will apply only to the maximum extent permitted by law and the remaining provisions will continue to apply.

22. NO WAIVER

If KOWA does not immediately enforce a provision of these Terms, that does not constitute a waiver of KOWA’s right to enforce that provision later.

This section does not limit any mandatory consumer right.
